    WHO CAN PARTICIPATE

    The Promoter is not responsible if the Eligible Entrant’s mobile device/desktop is not sufficiently capable for the purpose of submitting an entry. An entry is deemed to be received only when received by the Promoter’s database. The Promoter’s receipt of an entry will be confirmed by an acceptance message which appears on screen once an entrant has completed and submitted the Entry Form. 

    One (1) entry into the Prize Draw will be recorded for each Qualifying Purchase.     The winners will be required to sign a Participation Agreement in the form required by the Promoter, confirming acceptance of these Terms and Conditions of Entry & Prize; accepting the Terms and Conditions relating to the use and enjoyment of the Fiji Prize; releasing the Promoter, and it’s officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies from any and all liability in connection with this promotion and/or the Fiji Prize. 

    WINNER NOTIFICATIONS 

    All winners will be contacted using the phone number and/or email listed in their Entry Form by 5.00pm 13th February 2025. Each winner has until the 20th February 2025 to respond to the prize notification by email or phone.

    The Promoter is not responsible if a winner cannot be contacted due to incorrect or out of date contact details being supplied in their Entry Form. If a winner cannot be contacted or does not respond to the prize notification, any such winner will forfeit the prize to the next eligible winner on these Terms and Conditions in accordance with the Re-Draw provisions below.

    RE-DRAW (IF ANY) 

    If any winner is unable to be contacted by phone or email, or does not respond to the prize notification by 5.00pm NZT on 24th February 2025 a re-draw will be conducted from all remaining Eligible Entries received during the Promotion Period at 5.00pm NZT on 25th  February 2025. The re-draw winner (if any) will be notified via email and/or by phone by 5.00pm NZT 26th February 2025.

    GENERAL 

    The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries.

    The prizes must be taken as stated and may not be varied. The prizes are not transferable or exchangeable and the cannot be taken as cash. If a prize is unavailable for any reason the Promoter may provide another prize of equal or higher value, subject to any applicable law.

    All costs associated or arising in connection with redeeming prizes are the responsibility of the respective prize winners.

    The Promoter, the Promoter’s related entities and all agencies associated with the promotion are not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using a prize, except for any liability which cannot be excluded by law. To the extent permitted by law, liability is limited to the cost of replacing the prize won.

    Winners have rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoter.  These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose, and that any services provided by the Promoter will be rendered with due care and skill.  These Terms and Conditions do not, and do not intend to, exclude or limit those statutory rights in any way.  However, to the extent it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the prizes awarded as part of this Promotion and will not be responsible for breach of such representations or warranties.

    Winners and the Winners companion must provide proof of identity and proof of age in order to claim their prizes and prove their eligibility.  The Promoter may refuse to award a Prize to you if, in the Promoter’s sole opinion, you have breached these terms and conditions or has gained an unfair advantage in participating in the Promotion.

    The Promoter’s decision is final, and no correspondence will be entered into.

    Any person suspected of cheating in the opinion of the Promoter through the manipulation of entry, creation or use of software to aid in multiple entries and otherwise fraudulently falsifying data or acting in any way fraudulent, in the opinion of the Promoter, will be removed from this Promotion and damages may be sought.

    If, for any reason beyond the Promoter’s reasonable control, any aspect of the Promotion is not capable of running as planned, or the conduct or operation of the Promotion is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, or acts of Government, civil unrest, strikes, pandemics, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to, in its sole discretion, cancel, terminate, modify, suspend or recommence the Promotion, or invalidate any affected entries, at any time without prior notice, subject to any applicable law.

    The Promoter (including its officers, employees and agents) excludes all liability (including negligence) for claims, losses (including loss of opportunity), damages, injuries, costs and/or expenses, whether direct, indirect, special or consequential, suffered, sustained or incurred as a result of, or arising in any way out of, or in any way connected with, the Promotion or any Prize, except for any liability that cannot be excluded by law (in which case that liability is limited to the greatest extent allowed by law).

    You consent to the Promoter using your name, likeness, image and/or voice in the event you are a Winner for the purposes of communicating the outcome of this Promotion.

    The Promoter collects entrants’ personal information in order to conduct the Promotion. Entry is conditional on providing this information. By entering this Promotion, unless otherwise advised, each entrant agrees that the Promoter and its agencies may use the entrant’s personal information to conduct the Promotion in accordance with these Terms and Conditions (including to send electronic messages or telephone the entrant in relation to the Promotion).

    All personal information provided by you will be held for the Promoter at Farrimond Ltd, Level 1, 5 Eglon Street, Parnell, Auckland, New Zealand or such other place as is notified to you on request and otherwise in accordance  with the Coca-Cola Europacific Partners N.Z. Limited Privacy Policy that can be accessed by visiting https://www.cocacolaep.com/company/privacy-notice/.  The Privacy Policy also contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the New Zealand Information Privacy Principles or any other applicable law and how those complaints will be dealt with. Winners should direct any request to access, update or correct information to the Promoter at the postal address provided below. The Promoter will destroy all personal information for all entries once the prize has been claimed.

    The Promoter reserves the right to modify these Terms and Conditions of Entry where reasonably required and will endeavour to publicise those changes wherever possible.
